Heggstad Petition
A Heggstad petition is used in the unfortunate situation where a person created a trust, but never formally transferred the asset in to the trust. This petition filed with the Probate Court allows a Judge to confirm the decedent’s intent to have the asset in the trust. Thus, allowing the asset to be transferred into the trust, after the Settlor(s) passing, without having to go through probate, under certain circumstances.
Probate
Probate is when the Probate Court supervises the process of transferring legal title of property from the estate of the person who has died (with or without a will) to his or her beneficiaries. This process can take several months to years. We can assist you through this lengthy court process.
